Terms of Service of Kitwaii

These Terms of service apply generally with the use of the Kitwaii website and any other related agreement or legal relationship with the Kitwaii owner in a legally binding way. 
By accessing or using our website or services, you agree to be bound by these Terms. Users must read this document carefully. 
Kitwaii provides an online platform for customers to purchase art kits. You may use our website and services for lawful purposes only. You may not use our website or services, or material from it, to engage in any conduct that is illegal, harmful, or infringes on the rights of others. 

By using the Kitwaii website, users confirm they are older than the age of 13. 

Content

Unless otherwise specified or clearly recognisable, the content on the Kitwaii website including but not limited to, the text, images, logos, designs and images, belong to the owners of Kitwaii or its licensors. 
The Owner makes all efforts to ensure that content provided on the Kitwaii website infringes no applicable legal provision or third-party rights. However, in the case where there has been, we kindly ask users to report related complaints to the contact details in this document. 

Intellectual property

The Owner holds and reserves all intellectual property rights for content on the Kitwaii website. Without limitation, users may not copy, modify, sell, sublicense, edit, transfer/assign or create derivative works from the content available on Kitwaii. You may not use or reproduce the Kitwaii website content without our authorisation. 

Orders & Payment

Any steps taken from choosing a product to order submission at the checkout form part of the purchasing process. The end of the purchasing process is when payment has been made. This determines contract conclusion and creates the user the obligation to pay the price, taxes and possible further fees as specified on the purchase page. 

When you place an order on our website, you agree to pay the total amount shown at the checkout. Orders may be cancelled or refunded at our discretion. 
Where a product purchase requires an action from the User, such as the provision of personal details, the order submission creates an obligation for the User to cooperate.

Prices

Users are informed during the product selection and purchasing process about any fees, taxes and costs, (including delivery cost if applicable), that they will be charged.

Methods of Payment

Some payments may only be available subject to an additional condition or fee.
All payments are processed independently through third party services. Kitwaii only receives a notification once the payment has been successfully completed. 
If a payment through the available methods fails or is refused by the payment service provider, the Owner will be under no obligation to fulfill the order. 

Delivery

Deliveries are made to the address provided by the User as specified in the order summary. Upon delivery, Customers must verify the content of the Kit and report any faults, missing items, or anomalies without undue delay. Delivery times are specified on the Kitwaii website during the purchasing process.

Failed Delivery

The Owner cannot be held responsible for delivery errors due to the information provided by the User at the completion of the purchase order. 

The Owner cannot be liable for any damages or delays after the order has been handed to the carrier.

If the goods are not accepted, received or collected at the time of delivery or within the deadline specified, the goods will be returned to the Owner. The Owner will contact the user to make a second delivery attempt, at the User's expense or find an agreed course of action. 

Limitation of Liability

Without prejudice to the applicable statutory product liability provisions and consumer law, Users shall have no legal right to claim damages against Kitwaii and its Owners.

Kitwaii and its Owners shall not in any event, be liable for any damages, including direct, indirect, incidental, punitive or consequential damages, arising from the use of our website or service.

Kitwaii and its Owners shall not in any event, be liable for damages for the misuse of our kits for any purposes other than the creation of the final craft product in and proper purpose. 

Indemnification

The User agrees to indemnify and hold Kitwaii and it's owner, officers, agents, partners, employees and other associated persons, harmless from and against any claim or demand, made by any third party due to or in relation with any culpable use of the Kitwaii website, connection to the service or violation of these Terms. 

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms will be resolved in an Australian Court. If any of the terms in this document conflict with the Laws of Australia, they will be void and severed to the extent of the inconsistency and the remainder of the terms will continue to operate.

Changes to Terms:

Kitwaii reserves the right to modify these Terms at any time, without notice. Changes to these Terms will be posted on the Kitwaii website. By continuing to use our website or services after the changes to the Terms, you agree to the revised terms.
